FTC proposes 16 CFR Part 461 rule targeting platforms that further government/business impersonation scams

On 1 October 2026 the FTC published an Advance Notice of Proposed Rulemaking (ANPRM, 91 FR 62347, Matter R207000) to regulate search engines, social media and other digital marketplace platforms that knowingly facilitate government and business impersonation scams — the top fraud category with ~$3.5B reported losses in 2025. Comments are due 30 November 2026.
AI-generated deepfakes and voice clones are the emerging vectors driving impersonation scams, and the rulemaking would place obligations on the platforms that host or distribute AI-generated impersonation content, not just the scammers. It is a concrete federal AI-adjacent consumer-protection rule under construction.
Platforms and AI-content distributors should file comments by 30 November 2026 and assess current impersonation/content-moderation controls; providers of AI voice/video clone tools should track the rule's trajectory for downstream responsibility.
